Terms of Service

1. Acceptance of Terms

Important:

These Terms of Service ("Terms") are an agreement between you and EnviaLabs, governing your use of AutoArchiveX on the web and on iOS/Android. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

By accessing or using AutoArchiveX ("the Service"), operated by EnviaLabs, you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all visitors, users, and others who access or use the Service, including via our website and mobile applications (iOS and Android). If you disagree with any part of these terms, then you may not access or use the Service.

The Service is intended for individuals who are at least 16 years old. By using the Service, you confirm that you meet this age requirement.

2. Description of Service

AutoArchiveX is a digital platform that allows users to:

  • Track and manage vehicle service history
  • Store maintenance records and invoices
  • Securely transfer vehicle ownership with complete service history
  • Receive maintenance reminders and alerts
  • Access AI-powered maintenance recommendations and an AI Mechanic chat assistant
  • Track fuel consumption and costs

3. User Accounts

3.1 Account Creation

  • You must provide accurate and complete information during registration.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 16 years old to create an account.
  • Each individual may maintain only one account.

3.2 Account Security

  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use or security breach.
  • We recommend enabling two-factor authentication for enhanced security.
  • You must use strong, unique passwords.

4. Acceptable Use

You may use the Service to:

  • Manage your own vehicle service records.
  • Transfer vehicles you legally own to other legitimate users.
  • Access features as intended by the platform.
  • Export your data for personal use.

5. Prohibited Uses

You may not use the Service to:

  • Violate any applicable local, national, or international laws or regulations.
  • Infringe upon the intellectual property rights of others.
  • Upload or transmit malicious software, viruses, or any other harmful content.
  • Attempt to gain unauthorized access to our systems or other users' accounts.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Use automated systems (bots, scrapers) to access the Service without explicit permission.
  • Create fake or fraudulent accounts or share false or misleading information.

6. Content and Data

6.1 Your Content

  • You retain ownership of all content and data you upload to the Service.
  • You grant us a limited, worldwide, non-exclusive license to use your content solely for the purpose of providing and improving the Service.
  • You are solely responsible for the accuracy, legality, and appropriateness of your content.
  • You must have all necessary rights to any content you upload.

6.2 Content Standards

  • Content must be accurate, truthful, and not misleading.
  • Content must not violate any laws or third-party rights.
  • Content must not be harmful, offensive, defamatory, or inappropriate.
  • Content must not contain personal information of others without their consent.

6.3 Content Removal

We reserve the right to remove any content that violates these Terms or applicable laws. We may also remove content at your request, subject to our data retention policies.

7. Privacy and Data Protection

Your privacy is paramount to us. Our collection, use, and protection of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference. By agreeing to these Terms, you also agree to our Privacy Policy.

8. Intellectual Property

8.1 Our Rights

  • EnviaLabs owns all rights, title, and interest in and to the Service, including all software, technology, trademarks, logos, and content (excluding user-generated content).
  • Our trademarks, logos, and branding are protected by intellectual property laws.
  • Our software and underlying technology are proprietary and confidential.

8.2 Your Rights

  • You retain ownership of your personal data and content you upload.
  • You may export your data at any time, subject to the functionality of the Service.
  • You may request deletion of your account and associated data, as outlined in our Privacy Policy.

9. No Fees and No Ads

The Service is currently offered free of charge with no subscriptions, in-app purchases, or advertising. If fees or advertising are introduced, you will receive at least 30 days' advance notice and the opportunity to delete your account and data before changes take effect.

10. AI Features Disclaimer

AI-powered features — including the AI Mechanic chat, invoice extraction, vehicle intelligence, and service schedule recommendations — are provided for informational purposes only. They do not constitute professional mechanical, safety, legal, or financial advice. AI responses may be inaccurate or incomplete. Always consult a qualified mechanic or relevant professional for safety-critical vehicle decisions. EnviaLabs is not liable for any decisions made based on AI-generated content.

11. Service Availability

11.1 Uptime and Maintenance

  • We strive for high availability but cannot guarantee 100% uptime.
  • Scheduled maintenance will be announced in advance whenever possible.
  • Emergency maintenance may occur without prior notice to ensure service stability and security.

11.2 Service Modifications

We may modify, suspend, or discontinue the Service, or any part of it, at any time without prior notice. We will provide reasonable notice for significant changes that may impact your use of the Service.

12. Termination

12.1 Termination by You

  • You may terminate your account at any time through your account settings.
  • Termination will be effective immediately upon completion of the process.
  • You may export your data before termination, as per our Privacy Policy.

12.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice or liability, if you:

  • Violate these Terms of Service.
  • Engage in fraudulent or illegal activity.
  • Abuse the Service or other users.

12.3 Effect of Termination

  • Your access to the Service will cease immediately.
  • Your data will be deleted or anonymized according to our data retention policy.
  • Certain provisions of these Terms (e.g., Intellectual Property, Disclaimers) will survive termination.

13. Disclaimers and Limitations

13.1 Service Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

13.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENVIALABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

13.3 Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT OF ONE HUNDRED U.S. DOLLARS ($100).

14. Indemnification

You agree to indemnify and hold harmless EnviaLabs and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service or violation of these Terms.

15. Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sri Lanka, without regard to its conflict of law provisions.

15.2 Dispute Resolution Process

  • Informal Resolution: Contact us first to resolve any disputes informally.
  • Mediation: If informal resolution fails, we may agree to attempt mediation.
  • Arbitration: Disputes may be resolved through binding arbitration in Sri Lanka.
  • Class Action Waiver: To the extent permitted by applicable law, you waive the right to participate in class action lawsuits.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by:

  • Posting the updated Terms on our website.
  • Sending an email notification to your registered email address.
  • Displaying a notice within our application.

Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.
